Tax residency in Northern Mariana Islands
For individual income tax purposes, the Commonwealth of the Northern Mariana Islands treats a person as a resident only if the individual is a bona fide resident of the CNMI for the taxable year under Internal Revenue Code section 937 and Treasury Regulations section 1.937-1, which requires satisfying all of the following: (1) a presence test met by any one of these alternatives—present in the CNMI for at least 183 days during the year; or present in the CNMI for at least 549 days during the current year and the two preceding years with at least 60 days in each such year; or present in the United States for no more than 90 days during the year; or having no more than USD 3,000 of earned income from U.S. sources and being present in the United States for no more than 90 days during the year; or having no significant connection to the United States (day counting and limited exclusions are determined under the regulations); (2) no tax home outside the CNMI during the year; and (3) no closer connection to the United States or a foreign country than to the CNMI, based on the location of the individual’s permanent home, family, personal and business ties, and similar factors. An individual who does not meet these conditions is a nonresident.
