Tax residency in U.S. Virgin Islands
An individual is a U.S. Virgin Islands tax resident for a taxable year only if they are a bona fide resident of the USVI, which requires satisfying all three of the following for that year: (1) the presence test, met if any one of these is true: present in the USVI for at least 183 days during the year; or present in the USVI for at least 549 days in the current year and two preceding years with at least 60 days in each of those years; or present in the USVI for at least 60 days in the year and not present in the United States (the 50 states and the District of Columbia) for more than 90 days in the year; or present in the USVI for at least 60 days in the year, have no more than $3,000 of earned income from sources outside the USVI, and be present in the USVI for more days than in the United States; (2) the tax home test, meaning no tax home outside the USVI during the year; and (3) the closer connection test, meaning stronger personal and economic ties to the USVI than to the United States or any foreign country. For day-counting, any day of physical presence in the USVI generally counts, subject to limited exceptions (e.g., certain transit or medical absences).
