Tax residency in Saint Helena
An individual is treated as tax resident in Saint Helena for a year of assessment (1 April to 31 March) if they are ordinarily resident in Saint Helena during that year. Ordinary residence is the place where a person normally lives on a settled basis as part of the regular order of life, determined by all the facts and circumstances, including whether a permanent home is available in Saint Helena, the location of family and social ties, the place of employment or business, the pattern, length and purpose of stays in and absences from Saint Helena, and the individual’s intention to live there. There is no statutory day‑count test; short, temporary visits do not in themselves create residence, and temporary absences do not by themselves break ordinary residence where a home and a settled intention to live in Saint Helena are maintained. An individual who is not ordinarily resident in the year is non‑resident. In cases of potential dual residence under a tax treaty, residence for treaty purposes is determined by the treaty tie‑breaker (generally considering permanent home, centre of vital interests, habitual abode, nationality, and, if needed, competent authority agreement).
